By booking a charter or accessing our Service, you agree to comply with these Terms. If you do not agree with any part of these terms, then you are not permitted to use the Service.
2. Service Overview
OpenMeadowCollective offers a range of high-end yacht chartering services, such as:
- Day trips on a yacht
- Evening boat tours
- Company retreats
- Exclusive gatherings
- Extended yacht charters
Availability and weather conditions influence our service offerings. We retain the right to revise or terminate services at our discretion.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you must:
- Be at least 18 years old
- Provide truthful and complete information
- Submit the necessary deposit as indicated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is subject to the receipt of payment and our formal written confirmation. We maintain the right to decline service at our sole discretion.
3.3 Availability
All charters depend on the availability of vessels and favorable weather conditions. We will endeavor to meet your requested dates and times as best as we can.
4. Payment Terms
4.1 Pricing
All listed prices are in £ and include any applicable taxes unless specified otherwise. Prices may change without prior notice.
4.2 Payment Schedule
- Initial Deposit: 50% of the entire cost of the charter required at the time of reservation
- Remaining Balance: Due 48 hours before the charter's scheduled departure
- Other expenses (if any): Payable after the charter's completion
4.3 Payment Methods
We accept various forms of payment including major credit cards, wire transfers, and certified bank drafts. Payments are processed through protected, encrypted services.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours notice before departure: Complete refund minus service fees
- Between 24 and 72 hours notice before departure: 50% refund
- Less than 24 hours notice before departure: No refund provided
5.2 Weather Cancellations
If the captain deems weather conditions to be unsafe, we will propose to:
- Reschedule the charter without extra charges to another available date
- Issue a full refund if rescheduling is not feasible
5.3 Mechanical Issues
Should your designated vessel encounter mechanical issues, we will endeavor to provide an appropriate alternative. If there is no suitable replacement available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers must:
- Adhere to all instructions given by the crew
- Utilize safety equipment as necessary
- Inform us of any health conditions that could affect their safety on board
- Stay within the assigned areas on the vessel
6.2 Prohibited Items
The following items are not allowed on board:
- Glass containers
- Illicit materials
- Weapons of any kind
- Excessive quantities of non-alcoholic beverages (beyond what is considered reasonable consumption)
- Pets (unless prior approval is granted)
6.3 Conduct
Passengers are expected to behave respectfully. We reserve the right to end a charter prematurely without offering a refund if a passenger's conduct is deemed to risk safety or negatively affect other passengers' experience.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount you have paid for the charter. We are not held liable for:
- Injuries caused by passenger negligence
- Property loss or damage
- Indirect, consequential, or punitive losses
- Delays due to weather or events beyond our control
7.2 Insurance Coverage
We ensure all our vessels and operations are covered by comprehensive marine insurance. It remains your obligation to secure personal travel insurance.
7.3 Assumption of Risk
Engaging in our yacht services signifies your acceptance of the inherent risks associated with marine activities. You acknowledge your own responsibility for your safety and security.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, routes, or timetables due to weather or safety considerations, or operational necessities. We will strive to provide equivalent alternative arrangements.
9. Force Majeure
We are not responsible for any delays, cancellations, or changes caused by events beyond our control, which includes, but is not limited to:
- Extreme weather events
- Natural disasters
- Government directives
- Harbor shutdowns
- Vessel mechanical failures
10. Privacy and Data Protection
Your personal data is processed according to our Privacy Policy. Your use of our service implies your consent to our data collection and usage procedures outlined in the Privacy Policy.
11. Intellectual Property
The content available on our website, like text, images, and trademarks, are protected by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative content without our permission is prohibited.
12. Governing Law
The governing law for these Terms is that of United Kingdom. Any related disputes will be handled exclusively by the courts in Southampton, United Kingdom.
